Revised Version of Form I-9 Issued

By Catherine Gordon, Toolkit Staff Writer

The U.S. Citizenship and Immigration Service (USCIS) has issued a new version of Form I-9, Employment Eligibility Verification. This form is used to verify the identity and employment authorization of individuals hired for employment in the United States. The latest version of the form is dated August 7, 2009, and expires on August 31, 2012.

The revised version of the form does not contain any substantive changes from the previous version of the form, which has a revision date of February 2, 2009, and an expiration date of June 30, 2009, which had been previously extended. Therefore, employers may continue to use the Form I-9 with the February 2, 2009, revision date.

Using Form I-9, all employers must verify the identity and the eligibility to work in the United States of all employees hired after November 6, 1986. In some cases, employers must reverify the identity and the eligibility to work for purposes of an individual's continued employment.

The revised version of Form I-9 incorporated the changes made to the list of documents that are acceptable to establish identity and employment authorization. The completed form is not sent to the government. However, employers must keep it in their files for a statutorily established period of time and must make the form available, upon request, for inspection by certain government officials.
