In Maine, work in excess of 40 hours in any one week must be compensated at a rate of one and one-half times the regular hourly rate. However, the overtime pay requirements do not apply to: (1) mariners; (2) employees involved in the processing, marketing and storing of perishable goods, agricultural products, meat and fish products; (3) hotel, motel and restaurant employees (exemption effective before July 18, 2008); (4) automobile mechanics, parts clerks and salespeople. Also exempt are all persons exempt from state minimum wage requirements.
Effective June 29, 2005, a salaried employee is exempt from overtime pay if the employee works in a bona fide executive, administrative, or professional capacity and his or her regular compensation, when converted to an annual rate, exceeds 3000 times the state's minimum hourly wage or the annualized rate established by the United States Department of Labor under the Federal Fair Labor Standards Act, whichever is higher.
