Terms of Use

The following terms and conditions govern your use of the Business Owner's Toolkit.

You are granted a nonexclusive, nontransferable limited license to access and use for your internal use only the Business Owner's Toolkit Online Services and Materials (including software from the Business Tools area) as from time to time made available to you. This license does not cover any use by you of the foregoing materials for the providing or offering of any product or services to others. It is not to be used to provide information processing services or service bureau-type services to any third party. Further, you may not publish, broadcast, sell or otherwise redistribute downloaded information or materials for any commercial purposes.

All right, title and interest (including all copyright rights and other intellectual property rights) in the Online Services and Materials (in both print and machine-readable forms) belong to the Toolkit media group. You acquire no proprietary interest in the Online Services or Materials, or copies thereof.

You may not use the Online Services or Materials retrieved from the Business Owner's Toolkit in any fashion that infringes copyright or proprietary interests therein, including any patent, trade secret, trademark, or similar intellectual property right.

You may not remove or obscure the copyright notice or other notices contained in materials retrieved from the Business Owner's Toolkit.

The publisher is not engaged in rendering legal or other professional services. If legal or other expert assistance is required, the services of a competent professional person should be sought.

Disclaimer of Warranty.
The Business Owner's Toolkit online services and materials (including software from the Business Tools area) are provided "as is" without warranty of any kind. Further, the publisher does not warrant, guarantee, or make any representations regarding the use, or the results of the use, of the software or the materials in terms of correctness, accuracy, reliability, or otherwise. you assume the entire risk as to the results and performance obtained from the Business Owner's Toolkit online services and materials (including software from the "Business Tools" area).

The publisher assumes no responsibility for and hereby disclaims all warranties, oral or written, express or implied, including, without limitation, the warranties of merchantability and of fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so portions of the above may not apply to you. This warranty gives you specific legal rights, and you, as licensee, may have other rights that vary from state to state.

Limitation of Liability.
The publisher shall not be liable to you, as licensee, or to any third party for any direct, indirect, special, consequential, or incidental damages (including damages for loss of business profits, business interruption, loss of business information, and the like) arising out of the use of or inability to use the Business Owner's Toolkit online services and materials (including software from the "Business Tools" area) even if the publisher has been advised of the possibility of such damages.

Laptop Giveaway Terms

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning.

2. ELIGIBILITY: giveaway open only to legal residents of the 48 contiguous United States and the District of Columbia, 18 years of age or older. Employees of the Business Owner's Toolkit and their respective parents, subsidiaries, affiliated companies, and agents, and foregoing employees' household or immediate family members (defined as parent, spouse, child, sibling, or grandparent) are NOT eligible to win. Winners of a prize in a given month are ineligible to win the same prize in subsequent monthly drawings.

3. TIMING: Monthly drawings begin 10/1/07 and ends at 9 /1/08. Twelve giveaways will occur.

4. HOW TO ENTER: Correctly complete toolkit membership process(all required fields must be fully and accurately completed) and transmit as directed.

5. PRIZE: One (1) Dell Vostro laptop computer valued at $449, or a laptop of equal or higher value, will be given to a randomly-selected, registered member of the Business Owner's Toolkit website.

6. RANDOM DRAWING: On or about the first business day of each month, a winner will be selected by random drawing from all eligible members. Drawing conducted by officials from the Business Owner's Toolkit, whose decisions on all matters related to this drawing shall be final and binding. A member selected as a potential winner must comply with all terms and conditions set forth. Odds of winning depend on the total number of registered members.

7. NOTIFICATION: Potential winner will be contacted by email within about 24 hours of drawing, and will be provided with a telephone number that a potential winner must call within 24 hours of prize notification ("Call Deadline") to confirm eligibility and availability for the laptop. Failure to comply with the requirements of this paragraph may result in disqualification and in the forfeiture of any right the prize.

8. E-MAIL ADDRESS: Entries will be deemed to have been submitted by the natural person who is the authorized account holder of the submitted e-mail address at the time of entry (proof thereof may be required of winner).

9. RELEASE: By participating and/or accepting a prize, a participant/winner consents to and gives the Business Owner's Toolkit the right to publicize the winner, and in perpetuity to use winner's/participant's, prize information, statements, quotes and descriptive information, in whole or in part, as may be adapted, edited, or modified for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without additional consideration, unless prohibited by law. Entries will not be acknowledged or returned and Business Owner's Toolkit shall have the right to use, assign, edit, modify or dispose of an entry however they see fit without the approval of participant/winner.

10. CONDITIONS: Participants agree that by participating they release the Business
Owner' sToolkit from any liability in connection with: a) Entries that are ineligible as a result of being lost, late, illegible, damaged, incomplete, stolen, postage due, or misdirected; b) Any typographical or other human or technical errors in the offer or administration of this giveaway, including but not limited to errors in advertising, these official rules, the selection and announcement of winners or the distribution of prizes; c) Any omission, interruption, deletion, defect, delay, misdirection, damage, injury, technical malfunctions or traffic congestion on the Internet/telephone network, or at any website or any combination thereof.

Business Owner's Toolkit reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the giveaway. In the event that the giveaway is challenged by any legal or regulatory authority, or is infected by a computer virus/worm, or is not capable of running or being executed as planned (as a result of but not limited to an error, omission, defect, delay, misdirection, tampering, unauthorized intervention, fraud, action of entrants, or technical failure) or any other cause which in the sole opinion of Business Owner's Toolkit, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this giveaway, Business Owner's Toolkit reserves the right in their sole discretion to disqualify participants residing in any affected geographic areas, to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the giveaway. In the event of any cancellation, termination, modification or suspension, notice thereof will be posted at the website mentioned in rule 4 above, and the random selection of the winner(s) for remaining prizes will be made as determined solely by Business Owner's from among all eligible non-suspect and/or non-disqualified entries. In such event, Business Owner's Toolkit shall have no liability to any participant who is disqualified due to such an action. Failure to enforce any term of these terms shall not constitute a waiver of that provision.

11. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited or restricted.

12. WINNER'S LIST: A winner's list will be posted from each individual's membership area.
